Landlord Responsible for Loose Wood in Front of Building

DOS issued a violation notice to landlord for placing loose rubbish out for collection. The DOS inspector found loose wood in front of the building. Landlord claimed that the janitor placed trash out for collection when he left for the day at 5:00 p.m. and didn't place any wood on the curb. The ALJ ruled against landlord and fined him $100. Landlord appealed and lost. Even if the janitor didn't place the loose wood out, landlord was responsible for any items left out by tenants.
