Landlord Replaced All but One Staircase

Landlord applied for MCI rent hikes based on several improvements. The DRA ruled for landlord in part, granting increases for an intercom and entrance doors but denying any increase for staircases/risers. Landlord appealed. Landlord had replaced every stair, handrail, and hallway railing throughout the building from cellar to bulkhead except for the first flight of stairs on the west side of the building. This had been replaced a few years earlier. The DHCR ruled for landlord. Landlord replaced a substantial portion of the staircases/ risers.

It was reasonable not to replace the one staircase that was only four years old. Landlord didn't seek any rent increase for the prior staircase installation.
