Landlord Renewed Fuel Oil Storage Permit by Paying Fee to DOF

The Fire Department issued a violation notice to landlord for burning and storing fuel oil without a permit. Landlord claimed that it had paid a renewal fee for its fuel oil permit before the date of the violation. The ALJ ruled against landlord and fined it $300 because landlord had paid the fee to the Department of Finance instead of the Fire Department. Landlord appealed and won. The Fire Department admitted that payment to the Department of Finance renewed landlord's permit.
