Landlord Proved New Boiler Was Installed

The DRA granted landlord's MCI rent increase application based on boiler/burner replacement. Tenants appealed, claiming that landlord had merely repaired the old boiler. The DHCR ruled against tenants because landlord proved the boiler installation. Landlord's contract for the work to be done stated that the old boiler would be removed and a new one installed. The specifications plate on the boiler in question showed a manufacture date of 2006.

The specifications plate on the boiler in question showed a manufacture date of 2006. And information received from the manufacturer confirmed that a new boiler, with a serial number matching the one on the specifications plate, was delivered to the building at the time the MCI work was taking place.
