Landlord Proved It Sent Renewal Lease to Tenant

Rent-stabilized tenant complained to the DHCR in February 2021 that landlord refused to renew her lease. Landlord responded and said that it offered tenant a lease renewal on Aug. 31, 2020, but that tenant failed to sign and return the lease. Landlord submitted proof of mailing of the renewal lease offer. The DRA sent copies of landlord's answer to tenant on Aug. 23, 2021, and again on Nov. 22, 2021. Tenant didn't respond to either notice. The DRA then ruled against tenant and dismissed her complaint.

Tenant appealed and lost. She claimed that she had received neither the renewal lease offer nor the DRA's service of the landlord's answer. But the DHCR found no proof that the DRA didn't properly serve a copy of the landlord's answer on tenant at her mailing address. The USPS returned nothing to the DHCR.
