Landlord Proved It Made Adequate Cleaning Efforts

DOS issued a violation notice to landlord for having a dirty sidewalk. The notice stated that a large garbage bag had been ripped open and debris scattered in front of the building. The ALJ found that the building was in a commercial area and that landlord hadn't made adequate efforts to keep the sidewalk clean. The ALJ fined landlord $50. Landlord appealed, claiming that people rummaged through the garbage even though he cleaned in front of the building five times a day. ECB ruled for landlord and revoked the fine.
