Landlord Proved Individual Apartment Improvement Costs

Rent-stabilized tenant complained of rent overcharge. The DRA ruled for tenant and ordered landlord to refund $85,750. Tenant appealed and lost. Tenant claimed that the DRA should have disallowed more individual apartment improvement (IAI) costs totalling $21,000. Landlord's contractor was a superintendent at another building in the neighborhood. But landlord had an invoice and proof of payment. It didn't matter that the contractor was a super. The contractor's invoice specified what work was to be done in each of the apartment's eight rooms.
