Landlord Proved Delivery of Initial Registration

Tenant filed a fair market rent appeal. Landlord claimed that it sent tenant the initial rent registration form in January 1993 and that tenant didn't file the complaint on time. The DRA ruled for landlord and dismissed the case. Tenant appealed, claiming that she had received a notice of statutory decontrol in January 1993, rather than the initial registration. The DHCR ruled against tenant. In her original complaint, tenant had indicated that she received the initial registration in an envelope postmarked January 1993. Landlord also submitted a postmarked receipt for certified mailing.
