Landlord Proved Correction of Violations

Landlord applied for 1992-93 MBR increases. In support of its application, landlord filed a violation certification dated June 21, 1991. Landlord also submitted a sworn statement from its building super stating that landlord had corrected the required number of violations. The DRA ruled for landlord and granted the MBR increases. Tenant appealed, claiming that landlord hadn't corrected the required number of violations. The DHCR ruled against tenant. The violations tenant reported were filed after the eligibility date for the MBR increases in question.

Landlord also showed that these violations had been corrected.
