Landlord Proved $5,000 Payment Made

Tenant complained of a rent overcharge. The DRA ruled against tenant. Tenant appealed, disputing landlord's claim that apartment improvements had been made. The DHCR ruled against tenant. Landlord submitted proof of a $5,000 payment for apartment improvements. Landlord's check was cashed and it was written at the time the work was done. Landlord's proof of the apartment improvements was sufficient, and there was no overcharge.
