Landlord Painted Apartment

Tenant complained of a reduction in services because her apartment hadn't been painted in more than three years. The DRA ruled for tenant and reduced her rent. Landlord later applied for a rent restoration based on the restoration of services. The DRA ruled for landlord. Tenant appealed and lost. Tenant claimed that landlord still hadn't painted the apartment. Landlord had filed a prior rent restoration application in 2004. At that time, an inspection showed that some conditions still needed repair.

Tenant claimed that landlord still hadn't painted the apartment. Landlord had filed a prior rent restoration application in 2004. At that time, an inspection showed that some conditions still needed repair. But the inspector found that the apartment had been properly painted and plastered, except for work needed on the bathroom wall and under the kitchen sink. When landlord filed its second rent restoration application, the DRA had to consider only whether the remaining conditions had been corrected. A 2006 inspection showed that the remaining work had been completed.
