Landlord Not Responsible for Cost of Towing Tenant's Car

Rockland County public housing tenant sued landlord in small claims court for towing and storage costs after landlord had tenant’s car towed away. The court ruled for tenant and awarded him $3,000. Landlord appealed and won. Tenant’s lease permitted landlord to tow tenant’s car and landlord had given tenant adequate notice of its intention to do so. There was no violation of tenant’s due process rights.
