Landlord Not Required to Maintain Curbstone

LVT Number: 18816

Pedestrian sued landlord for negligence. She tripped and fell on a curb in front of landlord's building. Landlord asked the court to dismiss the case without a trial. Landlord argued that it wasn't responsible for maintaining the curbstone. The court ruled for landlord. N.Y.C. Administrative Code Section 7-210 was recently amended to impose duty on landlords to maintain sidewalks in front of their buildings. But the law doesn't cover curbstones, which remain the responsibility of the City of New York.
