Landlord Not Notified of Leak Recurrence

The DRA reduced tenant's rent based on bathroom ceiling leaks. Landlord filed an application to restore rent in December 1989, claiming that the leaks were fixed. In July 1990, an inspection showed water stains and seepage from the bathroom ceiling. The DRA ruled against landlord. Landlord appealed, claiming the bathroom ceiling had been repaired. Tenant had even signed a consent statement in November 1989, acknowledging that repairs were made. The DHCR ruled for landlord. Landlord wasn't put on notice that the leaks may have recurred and that additional repairs were needed.
