Landlord Needn't Offer Renewal Lease to Illegal Subtenant

Apartment occupant complained of improper eviction, claiming that landlord wouldn't renew a rent-stabilized lease in his name. The court ruled for occupant and directed landlord to give him a renewal lease. Landlord appealed, showing that the occupant was prior tenant's illegal subtenant and landlord didn't know he was there until he sent the lease renewal offer. The DHCR ruled for landlord. Landlord wasn't required to offer a renewal lease to the illegal subtenant.
