Landlord Needn't Maintain Scaffolding

Tenants complained of a decrease in building-wide services. Among other things, tenants claimed that the scaffolding surrounding the building was defective. An inspection showed that the scaffolding was loose and defective. The DRA ruled for tenants, and ordered landlord to repair conditions, including the scaffolding. For this condition, rent-controlled tenants' rents were reduced by $3 per month. Landlord appealed, claiming it wasn't responsible for maintaining the scaffolding. The DHCR ruled for landlord.
