Landlord Needn't Check for Recyclables in Regular Garbage

DOS issued a violation notice to landlord for putting recyclables and regular garbage out for collection in the same container. Landlord claimed that tenants put the recyclables in the bags with regular garbage and that it wasn't responsible for opening up the bags and separating the trash. The ALJ ruled against landlord and fined it $25. Landlord appealed and won. Trash collection rules were amended in 1997 so that landlords were no longer required to sift through individual household trash bags to ensure separation of recyclables.
