Landlord Must Register Rents Before Renewing Leases

At a certain point in a long-standing dispute between landlord and tenants over the lawful rents in a former residential hotel that had been reclassified under rent stabilization, the court ruled that landlord could issue renewal leases to tenants. This came after a long period of frozen rents due to discontinuation of hotel services. Tenants appealed, claiming that, before renewing leases, landlord must first register 1982 rents and 1983 services with the DHCR. The court agreed. Landlord must first register the existing rents.

Since there was still some dispute as to what the current maximum rents were, landlord could register the rents without prejudice to any claim it may have as to their correctness.
