Landlord Must Paint Apartment Every Three Years

LVT Number: #20129

Westchester tenant applied for a rent reduction, based on a reduction in services. Tenant claimed that landlord didn't paint her apartment after tenant advised landlord that it had been at least three years since the last painting. Landlord claimed that painting wasn't a required service. The DRA ruled for tenant. Landlord appealed and lost. In a prior proceeding, the DHCR already had ruled that painting was a required service for tenant's apartment. Landlord didn't appeal that decision. So painting was a required service and landlord must paint.
