Landlord Must Maintain Elevator Once Installed

DOB issued a violation notice to landlord for failing to maintain an elevator. The notice stated that the emergency stop switch was defective, that there was no access to the machine room, and that the elevator itself was inoperative. Landlord argued that it had installed the elevator, but that no elevator was required. Therefore, it had no obligation to maintain the elevator. The ALJ ruled against landlord and fined it $350. Landlord appealed and lost. The ECB ruled that once an elevator is installed, City Administrative Code Section 27-987 requires that it be maintained.
