Landlord Must Include All Work in Plans for Permit

The DOB issued a violation notice to landlord for doing work other than what was specified in landlord's alteration plans. Landlord had put up a fence, added a planter, and installed tile squares on the building roof. Landlord claimed that these were minor alterations. The ALJ found that the tile could affect the structural integrity of the roof and should have been included in the plans; landlord was fined $115. Landlord appealed, and the ECB ruled against landlord. The work, including roof renovation, was done under an open alteration based on approved plans.
