Landlord Must Get Fuel Cost Forms

The DRA revoked landlord's fuel cost increase for rent-controlled tenants for 2002 because landlord didn't timely file a 2002 report of fuel price decrease. Landlord appealed, claiming that the report forms weren't available from the DHCR in time to meet the May 1, 2002, filing deadline. Landlord claimed that it filed as soon as it got the forms. The DHCR ruled against landlord. The forms were readily available to the public before May 1.
