Landlord Must Correct Violations to Collect Increase

Landlord applied for MCI rent hikes based on the installation of new windows building-wide. The DRA granted the increases, and tenants appealed. They claimed that landlord couldn't collect MCI increases until it had corrected the outstanding building violations. The DHCR revoked the rent hikes, and sent the case back to the DRA for further consideration. The building had 368 outstanding violations, many of which were immediately hazardous and some of which pertained to the window installation.

Landlord must clear all immediately hazardous violations before the DRA will reconsider the MCI application.
