Landlord Must Add Husband's Name to Tenant's Renewal Lease

LVT Number: #26617

Rent-stabilized tenant complained that landlord refused to add her husband’s name to her renewal lease. The DRA ruled for tenant and ordered landlord to add the husband’s name. Landlord appealed and lost. Landlord claimed that tenant hadn’t provided a copy of her marriage certificate or proved that the husband primarily resided in the apartment. But tenant submitted a copy of a 1997 marriage certificate. The marriage certificate listed the apartment as the husband’s address.

And there was a reasonable presumption that tenant’s husband actually lived with tenant in the apartment as his primary residence.
