Landlord Must Add Husband to Renewal Lease Despite Bad Credit

LVT Number: 19148

Tenant complained that landlord refused her request to add her husband's name to her rent-stabilized renewal lease. The DRA ordered landlord to add tenant's husband's name to the lease. Landlord appealed and lost. Landlord questioned whether it had to add the husband to the lease regardless of the results of a credit check. The DHCR ruled that Rent Stabilization Code Section 2522.5(g) gives tenant the right to have her spouse added to the apartment lease on renewal. The results of the credit check didn't matter.
