Landlord Made Window Repairs

Landlord filed for MCI rent increases based on the installation of new windows. Some tenants complained that the windows were defective. The DRA ruled for landlord and granted the rent increases since landlord made repairs to any windows that needed them. A number of tenants appealed. Among other things, they claimed for the first time that there was no frosted privacy glass installed in the bathroom windows. The DHCR ruled against most tenants, refusing to consider new issues on appeal.

The rent increases were revoked for two tenants who claimed that repairs hadn't been made to windows in their apartments and that they hadn't signed off on the form conceding that repairs were done.
