Landlord Made Reasonable Efforts to Keep Property Front Clean

DOS issued a violation notice to landlord for having a dirty area in front of his building. Landlord claimed that he made reasonable efforts to keep the area in front of the building clean. The ALJ ruled against landlord, finding that the building was near a sanitation department depot. For this reason, the ALJ said, landlord's efforts were not sufficient. Landlord appealed, arguing that the building was not near the depot. ECB ruled for landlord and revoked the $50 fine. The map landlord submitted showed that the building was not near the sanitation depot.
