However, the DRA disallowed a claimed cash down payment of $2,315 because it wasn't proved. Landlord appealed. Landlord had submitted a sworn statement from its contractor that landlord had paid a cash down payment of $2,315. The DHCR ruled for landlord. Landlord paid a total of $10,860 for 51 new thermal windows. There was sufficient proof, with the contractor's statement, that landlord had paid the total claimed for the windows, including the cash down payment.
