Landlord Locked Entrance Door

The DRA reduced tenants' rents, based on a reduction in services. Landlord later applied for rent restoration. Landlord stated that it had fixed the defective vestibule door lock for which the rent reduction was ordered. The DRA denied landlord's application. An inspection showed that the door lock was defective. Landlord appealed, claiming that the vestibule door lock was continually being fixed and that it was repeatedly broken by vandals. Landlord submitted a list of repairs done to the lock, along with dates, amounts spent, and the company that did the work.

An inspection showed that the door lock was defective. Landlord appealed, claiming that the vestibule door lock was continually being fixed and that it was repeatedly broken by vandals. Landlord had also now put a lock on the entrance door outside the vestibule door because it provided better security than a lock on the vestibule door. A new inspection confirmed that the entrance door was now locked. In a related proceeding, the DHCR decided that this was an acceptable alternative to a locked vestibule door. So, the DHCR ruled for landlord and restored the rents.
