Landlord Left Damaged, Vacant Building to Deteriorate

DOB issued a violation notice to landlord for failing to maintain a building's walls or appurtenances. DOB's inspector observed the entire building in extreme disrepair and vacant due to fire damage. The vacant building continued to deteriorate. Landlord argued that it had sold the building and therefore couldn't be charged with the violation. The ALJ ruled against landlord and fined it $6,250. Landlord appealed and lost. The date of the violation notice was Sept. 20, 2019. The building was offered for sale at a public auction on June 10, 2019, under a foreclosure judgment.

But the building wasn't transferred to the new owner until Nov. 6, 2019. So landlord was still the owner in September 2019 and was properly responsible for the violation.
