Landlord Increased Rent Without Renewing Lease

Rent-stabilized tenant complained of a rent overcharge. The DRA ruled for tenant and ordered landlord to refund $2,200, including interest. Landlord appealed and lost. Landlord claimed that the DRA incorrectly found that tenant was month-to-month. Landlord said that tenant refused to sign renewal leases and that there should be deemed renewals. The DRA correctly determined that tenant had no lease for four years and had, in fact, complained that landlord had given her no lease since 2005.

Tenant had signed leases between 2001 and 2005, and signed a timely renewal lease offered in 2009. Landlord submitted no proof that renewal leases were offered for periods between Sept. 30, 2005, and Oct. 1, 2009.
