Landlord Improperly Replaced Trash Chutes with Outdoor Containers

Landlord asked the DHCR for permission to discontinue the use of interior trash chutes at its rent-stabilized building and provide outdoor containers for trash disposal. The DRA ruled against landlord, who filed its application only after modifying the service. Landlord appealed and lost. Landlord's new trash collection method didn't comply with New York City law, which required a trash compactor at the building. Landlord claimed that a compactor wasn't required because the building never had an incinerator. But landlord submitted no proof to support this claim.
