Landlord Harassed Tenant Through Baseless Eviction Proceedings

Landlord sued to evict rent-stabilized tenant for refusing to sign a renewal lease. Tenant claimed that landlord was harassing her. Tenant claimed that she had signed a renewal lease before landlord started the case, and a DHCR case file also contained a renewal lease signed by both tenant and landlord at around the time landlord started the eviction case. Landlord also had commenced prior eviction cases against tenant that were dismissed. The court found that landlord violated Admin. Code Section 27-2005(d) by harassing tenant and imposed a $2,000 penalty.
