Tenant complained that landlord refused to offer him a rent-stabilized renewal lease. Landlord pointed out that it had properly sent tenant a notice of its intention not to renew tenant's lease since landlord claimed the apartment wasn't tenant's primary residence. Landlord had also started a holdover proceeding for eviction of tenant.

The DRA terminated tenant's renewal lease proceeding but noted that if the court ruled in tenant's favor, landlord would be required to offer tenant a renewal lease.
