Landlord Got Second Mortgage on Property

Landlord applied for MCI rent increases based on installation of new windows. The DRA ruled for landlord, and tenants appealed. Among other things, tenants claimed that landlord was already compensated for the cost of the windows because it took out a second mortgage on the building. The DHCR ruled against tenants. Landlord's second mortgage didn't serve as compensation for the MCI and had no bearing on landlord's entitlement to the MCI rent increases.
