Landlord Gets MBR Increase Despite Tenant's Service Claims

The DRA granted landlord MBR increases for the 1988–89 cycle, effective Jan. 1, 1988. Tenant appealed, claiming that violations on record hadn't been removed and that landlord wasn't maintaining essential services. The DRA ruled against tenant, and tenant appealed. The DHCR ruled against tenant. Landlord certified by Dec. 31, 1987, that all rent-impairing violations and 80 percent of all other violations on record as of Jan. 1, 1987, had been removed. Although tenant alleged service problems, tenant didn't dispute the removal of the violations.
