Landlord Fined for Unseparated Recyclables

DOS issued a violation notice to landlord for placing recyclables out for collection with non-recyclables. The DOS inspector stated that he saw more than five plastic bottles mixed in with household trash placed out for collection. The ALJ ruled against landlord and fined it $100. Landlord appealed and lost. Since 16 RCNY Section 1-08 was amended in January 2011, it was no longer a defense that landlord had separated materials into proper containers prior to placement on the sidewalk. Landlord remained responsible for the improper mixing of recyclables with other trash.
