Landlord Fined for TV Set Left Out for Collection

DOS issued a violation notice to landlord after finding a television set illegally placed on the sidewalk in front of landlord’s building. Landlord claimed that she didn’t put the TV in front of her building. The ALJ ruled against landlord and fined her $100. Landlord appealed and lost. 16 RCNY 1-04.2 prohibits placement of any electronic waste, including televisions, out for DSNY collection. Landlord’s photograph of the TV was inadequate to refute the inference that it was placed in front of landlord’s building. Landlord was responsible for the condition.
