Landlord Fined for Defective Sidewalk Shed

DOB issued four separate violation notices to landlord for not properly maintaining a sidewalk shed during construction. The ALJ dismissed two of the violations, finding that they were for lesser offenses covered by the other violation notices. DOB appealed and won. One violation was issued because the side of the shed toward the building wasn't sealed. Another said the shed was unsafe because the upper enclosure panels had buckled and the column base shins had deteriorated, leaving the columns unsupported. A third was for cross planking that had deteriorated.

And the fourth was issued because the sidewalk shed was overloaded and the upper enclosure panels were buckling because the flex sign straps were too tight. These were all separate conditions. Landlord was fined $3,000.
