Landlord Fined for Ceiling Leak and Defective Wiring

DOB issued a violation notice to landlord for using unapproved electrical materials, equipment, and installations after DOB's inspector found a ceiling fixture in tenant's living room showing signs of water damage from the second-floor bathroom. This caused a circuit breaker to trip off. There also was defective wiring that could be a potential fire hazard. Landlord claimed that tenant never notified her of the condition before the violation was issued. Landlord submitted an electrician's bill and certificate of correction was issued by DOB.

The ALJ ruled against landlord and fined her $400. Landlord appealed and lost. It was no defense that tenant didn't notify landlord of the condition. And correcting the violation after the notice was issued didn't relieve landlord of responsibility or paying the fine.
