Landlord Fined $775 for Standpipe System Testing Violations

The FDNY issued two violation notices to landlord for failing to repair/replace defective piping between the lower check valve and Fire Dept. connection, and for failing to inspect or test the building's standpipe system pressurization. Landlord didn't dispute the violations and, at a hearing, showed work orders for their correction, as well as proof of correction. The ALJ imposed mitigated penalties totalling $775. Landlord appealed and lost.

The FDNY issued two violation notices to landlord for failing to repair/replace defective piping between the lower check valve and Fire Dept. connection, and for failing to inspect or test the building's standpipe system pressurization. Landlord didn't dispute the violations and, at a hearing, showed work orders for their correction, as well as proof of correction. The ALJ imposed mitigated penalties totalling $775. Landlord appealed and lost. Landlord could avoid a penalty only when a certificate of correction was filed with FDNY prior to the compliance date stated in the violation notice. In this case, the ALJ properly imposed mitigated penalties since the violations were corrected by the initial hearing date.
