Landlord Fined $25 for Placing Recyclables Out for Collection in Cardboard Box

The DOS issued a violation notice to landlord for leaving an improper curbside recycling container in front of its building. The DOS inspector noted that he observed rigid plastics and flooring left out for collection in a cardboard box that wasn't designated for metal, plastic, or flooring. The ALJ fined landlord $25.  Landlord appealed and lost. Landlord argued that she placed items out for "bulk collection," not for recycling, and that DOS hadn't picked the item up on the day scheduled.

But a cardboard box is never a proper receptacle for items placed out for DOS collection.
