Landlord Fined $1,000 for Pigeon Droppings on Side of Building

DOHMH issued a violation notice to landlord for committing or maintaining a nuisance, based on pigeon droppings observed on a window sill and on the walls and floor between landlord's building and the building next door. Landlord asked for dismissal of the violation because it was negotiating a contract with an exterminator to install bird nettings over the rooftop airshaft openings to prevent birds from nesting inside the shaft area. Landlord then planned to remediate the existing condition by removing droppings and disinfecting the area.

The ALJ ruled against landlord since no remediation efforts were begun before the violation was issued, and fined landlord $1,000. Landlord appealed and lost. Correction of a condition after the date of the violation notice wasn't a defense.
