Landlord Fined $100 for Snow/Ice Condition in Front of Building

DOS issued a violation notice to landlord for a snow/ice condition on the sidewalk in front of landlord's building. Landlord argued that she was away on the day of the snowstorm and didn't return until the following date. The ALJ ruled against landlord and fined her $100. Landlord appealed and lost. Landlord now argued that the snowstorm wasn't reasonably foreseeable because it wasn't in that day's weather forecast. But ECB wouldn't consider any new argument on appeal.
