Landlord Filed Late Registration

The DRA ruled against landlord because landlord hadn't filed initial and annual rent registrations for the building. Landlord appealed. While landlord's MCI application was pending, it submitted to the DRA proof of late registration filings. Under DHCR Policy Statement 90-9, landlord was entitled to the MCI rent hikes. The late filing of a registration results in the prospective elimination of any rent freeze penalty.
