Landlord Discontinued Preferential Rent in Accordance with Lease Rider

Rent-stabilized tenant complained of rent overcharge. She claimed that landlord improperly increased her rent upon renewal of her lease. The DRA ruled against tenant, who appealed and lost. Tenant signed a preferential rent rider with her vacancy lease, which stated that there was a preferential rent that landlord didn’t have to continue upon lease renewal. The DRA’s calculation of legal rents that could be charged to tenant properly reflected discontinuation of the preferential rent.
