Landlord Discontinued Illegal Use

DOB issued a violation notice to landlord for performing work without a permit. The work consisted of having a curb cut at the front of the building and creating a parking pad and car port. Landlord claimed that, in response to a prior, identical violation notice, he had discontinued the illegal parking. The ALJ ruled for landlord and dismissed the violation. DOB appealed and lost. DOB had previously advised landlord that he was in compliance with the law by discontinuing the illegal use. There was no claim that landlord had started any new work since the prior violation.
