Landlord Directed to Amend Rent Registration Error

LVT Number: #27980

Rent-stabilized tenant complained of rent overcharge, claiming that landlord improperly amended his 2015 annual apartment registration to reflect a legal rent of $1,945 per month. Landlord admitted that the correct legal rent should be $1,245. The DRA found that the apartment was properly registered at $1,245 in 2013, 2014, and 2016, and ordered landlord to amend the 2015 registration. Tenant appealed and lost. Tenant claimed that the prior amended 2015 registration was illegal and invalid. But the DRA properly directed amendment of the 2015 registration.

And there was no actual overcharge for the years in question since tenant's rent hadn't been increased.
