Landlord Didn't Wait Too Long to Sue Tenant for Rent

Landlord sued to evict tenant for nonpayment of rent. Landlord demanded unpaid rent for a 17-month period. Tenant claimed that landlord waited too long to sue for the back rent. The court disagreed and ruled for landlord. Landlord initially delayed suing tenant for tenant's benefit. But, when landlord did send tenant notice of its intent to evict, tenant filed for bankruptcy. Landlord then took all appropriate steps to comply with the DHCR regulations governing eviction proceedings.
