Landlord Didn't Submit Electrical Inspection Certificate

Landlord applied for MCI rent hikes based on an elevator upgrade. The DRA ruled against landlord based on landlord's failure to submit a certificate of electrical inspection from the DOB Bureau of Electrical Control. Landlord appealed, claiming that no certificate was required for the work done. Landlord also argued that it had submitted the "ELV-12" approval certificate, which was the only required document listed in the DHCR application materials. The DHCR ruled against landlord.

Landlord's application indicated that new wiring was installed as part of the elevator upgrade and the DRA asked for a Certificate of Electrical Inspection to prove that the new wiring met DOB safety standards. The DRA gave landlord three months to submit the requested certificate before denying its MCI application. While the DHCR application materials listed the ELV-12 certificate for elevator upgrade, it also listed certificates of electrical inspection for installation of new wiring. So this certificate was needed in addition to the general elevator certificate.
